Tony Russo is a litigator with experience in a variety of complex litigation matters in federal and state courts. He has represented clients in various commercial disputes, including cross-border litigation, bankruptcy, and foreign insolvency disputes. Tony has worked on trial teams in high-stakes cases.

Tony’s representations include:

  • The Litigation Oversight Committee to Genesis Global Holdco, LLC in two lawsuits against Genesis’s parent Digital Currency Group and its founder and affiliated entities and individuals, on behalf of creditors who are owed crypto assets worth approximately $2.2 billion. The complaints – one filed in the Delaware Court of Chancery and one in the U.S. bankruptcy court – include claims for breach of fiduciary duty, fraud, unjust enrichment, preference, and fraudulent transfer.
  • The Joint Official Liquidators of Fairfield Sentry Limited and two affiliated funds in Chapter 15 proceedings in Bankruptcy Court for the Southern District of New York, and before the U.S. District Court on appeal, asserting foreign avoidance, common law, and breach of contract claims, seeking to recover about $6 billion in redemption payments from hundreds of entities arising out of the Madoff Ponzi scheme.
  • Matterport Inc., against its former CEO following its loss in a phase one trial regarding the effectiveness of the company’s post-SPAC by-laws to lock up legacy shareholders. As new counsel in a five-day phase two trial in the Delaware Court of Chancery, defeated all remaining claims and cut the plaintiff’s damages in half on the claim lost in phase one.
  • Assured Investment Management and several of its managed funds in a Chapter 15 adversary proceeding in Bankruptcy Court for the Southern District of New York arising from the International Investment Group fraud, involving fraudulent transfer and aiding and abetting fraud and breach of fiduciary duty claims brought under New York and Cayman Islands law.

Tony earned his J.D. from University of Michigan Law School, cum laude, as a recipient of the Dean’s Scholarship. While in law school, he served as a Senior Editor of the Michigan Journal of Law Reform.
