The U.S. District Court for the Southern District of New York denied Binance’s motion to compel arbitration and enforce a purported class action waiver in Anderson, et al. v. Binance, et al., a putative class action involving claims that Binance offered and sold digital tokens in violation of federal and state securities laws.
In an Opinion & Order dated February 26, 2026, the Court denied Binance’s motion and held that the purported class-action waiver language in Binance’s 2019 Terms of Use is unenforceable in federal court for those claims. The ruling allows the plaintiffs’ claims to proceed in federal court.
