A team from Selendy Gay, led by partners Philippe Selendy, Jennifer Selendy, and Sean Baldwin, were named “Litigators of the Week” by The American Lawyer. The honor follows the firm’s trial and appellate victories that secured the largest earnout-related damages award in Delaware history – approximately $811 million on behalf of Fortis Advisors as representative for the former shareholders of Auris Health, a surgical robotics company involved in a long-running dispute with its acquirer, Johnson & Johnson (“J&J”).
In explaining the team’s successful litigation approach, Jennifer explained that they concluded early on that “each of us should master the entirety of the case,” rather than divide ownership, a strategy that proved critical given the complexity and fact-intensive nature of the proceedings and the need for continuity across trial and appeal.
Sean emphasized that the outcome reflected the firm’s long-term litigation philosophy. “The equity partners took extraordinary risks on this six-year odyssey of a case to press it to conclusion,” he said, noting that the result validated the firm’s commitment to pursuing complex, high-stakes matters through trial and appeal.
Reflecting on the victory, Philippe underscored the importance of partnership and collective strategy. “The depths of this partnership led to a rare perfection in strategizing, building and trying this extremely difficult case, together with our remarkable team,” he said.
